Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of The Burlington and its licensors. The Service is protected by copyright, trademark, and other laws of both Hong Kong and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of The Burlington. 

We consent to you viewing, retrieving, displaying and printing the contents of this website for you own, personal, non-commercial use, in connection with; viewing the information contained in this website, making a reservation, or making an order.  All or any other use requires our express consent.

Availability of the website and our service through the website

Although we will use all reasonable endeavors to ensure that this website (and its normal contents) are available to be viewed and used by you at all times.  There may be circumstances in which this is not the case, these include non-availability for maintenance and upgrading, and also events of force majeure i.e., event which are outside our reasonable control.

It is also possible that, from time to time, faults, omissions, and delays may occur in the service provided by this website and/or any products or service referred on it. There is no guarantee that the service provided on this website will meet all of your requirements, or will be fault free at all times.  If you experience a problem, please report it to us at stay@burlington-hk.com. We will do all we reasonably can to remedy any fault that occurs as soon as reasonably possible.

Contents of the website

We make no guarantees that the contents of this website, or any goods or services referred to on it, comply with local laws outside of Hong Kong SAR. If you are accessing this website from outside Hong Kong SAR, it is entirely your responsibility to ensure that your doing so complies with local laws.

Prices and Charging

All prices referred to on this website are given in good faith, but are subject to final confirmation on booking. Where any goods or services have been mispriced by mistake on this website, we are entitled to rectify that mistake without compensation at the time of booking.

All products and services are subject to 10% service charge where applicable.

Best Rate Guarantee

Terms and Condition for eligibility to claim for the Best Rate Guarantee

If you book a room on our website and within 24 hours of completing such booking, find a Public Internet Rate (as defined below) that is $1.00 or more lower than the room rate (not including any taxes or tariffs (federal, state, provincial or local) or other guest fees or charges which may be imposed by the hotel, “Room Rate”) at which you booked, then, subject to these terms and conditions, The Burlington will, upon validation of your claim, match the Public Internet Rate (the “Best Rate Deal”). For purposes of these terms and conditions “Public Internet Rate” means a Room Rate that is Viewable and Bookable (each as defined below) on another website for the same hotel, same room type, same number of guests, same currency and for the same date(s) as the hotel, room type, number of guests, currency and date(s) you booked. For purposes of these terms and conditions, a “Viewable” Room Rate means one for a hotel brand and/or specific hotel and location, which information the general public can view prior to booking, and a “Bookable” Room Rate means that one that is available and can be reserved online.

To be eligible to receive the Best Rate Deal:

Guarantee applies only to reservations made on our website for The Burlington.

(1) you must have a Burlington Hotel reservation confirmation number;
(2) you must complete and submit the claim form no later than (a) 24 hours after booking your room via one (1) of the methods described above (please contact our reservations department at stay@burlington-hk.com for the claim form); and (b) 48 hours prior to the hotel’s check-in time; and
(3) The Burlington’s customer service agents must be must be able to verify, to their satisfaction, that (a) the Public Internet Rate in question exists at the time of claim processing, and (b) the claim otherwise meets, and has been completed and submitted in accordance with, all terms and conditions of this program.

For clarity, and without limiting any of these terms and conditions, if your original reservation was made within 48 hours of the hotel’s check-in time, you will not be eligible to receive a Best Rate Deal under these terms and conditions.

Only one claim can be submitted per person, per email address per calendar month; any claims submitted in excess of this limit will be deemed void and not considered. All reservations must be for personal use only and booked by the guest who will actually be staying at the hotel. Reservations booked by brokers or agents or any other third party will not qualify. Best Rate Deals and any other discounted rates which may be issued under this program are not transferable.

The Burlington reserves the right to reject any claim and/or to cancel any discounted rate previously issued by it in the event of fraud or abuse of this program or non-compliance with these terms and conditions.

For a multiple night stay, the total Room Rate for the stay will be evaluated in determining whether the Public Internet Rate has a lower Room Rate.

Any Room Rate change is not effective until the guest receives an email confirmation reflecting the new Room Rate from our Reservations department. The standard claims processing time is 24 business hours. Claims submitted outside of normal business hours will be processed on the next day. Normal business hours are 9:00am – 6:00pm Hong Kong time. The Burlington recommends that the email confirmation of any Room Rate change be presented to the hotel by the guest at check-in.

Cases where Best Rate Guarantee does not apply:-

a)     Guarantee reservations made for PR do not qualify.

The rates available under these terms and conditions cannot be combined with any other special or promotional offers or discounts. For the avoidance of doubt, special rates available only to members of membership clubs, affinity programs or other organization, such as AAA or AARP, private rates, rates involving a prepaid voucher program, rates that require a coupon or promo code, rates for hotel rooms sold as a part of a travel package, corporate discount rates, group rates (5+ rooms), meeting rates, and any other rate(s) not intended for the general public do not qualify.

b)     Packaged rates. 

Packaged rates include; a) hotel rooms sold as part of a travel package, where the hotel does not provide the extra service. Extra services include but are not limited to hotel rooms plus airfares, car rental or cruises, and b) hotel rooms sole with value added amenities, including but not limited to, free breakfast etc.

c)      Unpublished rates (rates that are not publicly available). Such as the following which are not available to the general public:-

  • Group Rates
  • Corporate Discount Rates
  • Event and meeting delegate rates
  • Any closed rates requiring membership in a club or program or other organization where the rates are targeted toward a specific group
  • Direct mail offers
  • Electronic mail offers
  • Promotional Campaigns with rates quote by a code

d)     Any rates from opaque providers. 

Any opaque provider is any provider that prevents the buyer from identifying the hotel until after the buyer has made a reservation and guaranteed payment. A site is opaque if it does not divulge the name of the hotel, the precise location of the hotel, or other specific information which could enable identification of the hotel i.e. hotel photographs, name of the food and beverage entity etc.

e)     Void where prohibited by law.

The Burlington reserves the right to modify, alter, suspend or terminate this program at any time without prior notice at its sole discretion.

Methods of Payment

Methods of payment accepted: all Visa, MasterCards, China UnionPay, and AMEX (both online and on site). Google Pay and Apple Pay (online only).

Cancellation and No-show Policy

Rooms may be cancelled based on the cancellation policy as stipulated under room rate plan. Any cancellations after the time stipulated in the cancellation policy will result in a cancellation fee equivalent to the first-night room charge, plus 10% service charge. This policy excludes rooms booked on the non-refundable/non-changeable rate plans.

Please refer to the cancellation policy for the specific rate plan.

In the case of no-shows, the cancellation fee plus 10% service charge will be charged. Fees for any additional nights impacted by a no-show will be subject to management discretion.

You will be legally responsible and accountant for all your acts or omissions in connection with this website, and for all and any costs or losses that we may sustain as a result of any such act or omission by you. In the event that you use this website in a way that is not authorized, or is in breach of these Terms and Conditions, or if you access it from outside Hong Kong SAR and by doing so breach any local law or regulation, you will indemnify us and hold us harmless against any cost, claim or liability that we may incur as a result of you so doing.

Limitation of Liability

In no event shall The Burlington, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.


Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

The Burlington, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.


We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to satisfy yourself on each visit to the website that you are prepared to accept and agree the Terms and Conditions as at that date.

All amendments will come into effect immediately unless we indicate otherwise. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please cease using the Service.
